Mr. Pearson has 15 years of experience litigating matters in federal and state courts throughout Texas and the United States. He has extensive experience in cases involving insurance law, employment law, business and commercial law and serious personal injury.
Mr. Pearson’s insurance law practice involves representing policyholders (individuals and businesses) against insurance companies in individual cases and class actions. He has handled hundreds of individual cases against insurance companies involving claims of breach of contract, common law bad faith, statutory bad faith, Insurance Code violations and Deceptive Trade Practices Act violations. The types of insurance policies involved in these cases include homeowners, condominiums, business owners, workers’ compensation and disability. Mr. Pearson’s class actions experience includes representing policyholder for claims of breach of contract, antitrust, Deceptive Trade Practices Act violations, Insurance Code violations and other statutory violations.
In employment law matters, Mr. Pearson represents employees in lawsuits and arbitration proceedings involving claims of harassment, discrimination and retaliation under Title VII, the TCHRA, ADA, EPA and ADEA. He has also handled lawsuits involving claims of workers’ compensation retaliation, Sabine Pilot, civil rights violations, wrongful termination, breach of contract, and wage and hour issues. Mr. Pearson also has experience representing executives in matters including breach of contract, covenants not to compete, separation and severance agreements. Mr. Pearson has written several articles on employment matters including a chapter on summary judgment practice in Texas.
Mr. Pearson has represented business clients in individual cases and class actions. Business disputes have involved claims of breach of contract, misrepresentation, fraud, deceptive marketing, securities violations and civil RICO. A recent class action lawsuit involved the representation of small and large businesses against Verisign, Inc., the largest internet security firm, for deceptive marketing of digital certificates. The case was certified as a class and settled for approximately $40 million.
In addition to these areas of practice, Mr. Pearson also has experience handling serious personal injury cases in the areas of automobile/trucking accidents, product defects and premises liability.
During law school, Mr. Pearson was an associate editor on the St. Mary’s Law Journal and interned for Hon. Eugene Cook at the Texas Supreme Court and the Hon. Emilio Garza of the United States Fifth Circuit Court of Appeals. He is licensed to practice in Texas as well as the Northern, Southern, Western and Eastern District of Texas and the Fifth Circuit.
