Practice Areas and Expertise
Mr. Pearson’s insurance law practice involves representing policyholders (individuals and businesses) against insurance companies in individual cases and collective actions. He has handled hundreds of individual cases against insurance companies involving claims of breach of contract, bad faith, Insurance Code violations and Deceptive Trade Practices Act violations. Representative clients include school districts, apartment complexes, condominiums, commercial buildings, museums, historical buildings, hospitals and homeowners. Mr. Pearson also writes articles and frequently speaks on insurance law issues.
Mr. Pearson’s construction law experience involves representing homeowners and commercial property owners against general contractors, subcontractors, architects, engineers and developers for claims of negligence, breach of contract and other construction defects. He has represented school districts and owners of single family and multi-family properties, condominiums, hotels, hospitals and ambulatory surgery centers.
Mr. Pearson represents business clients in individual and class action cases. Business disputes have involved claims of breach of contract, misrepresentation, fraud, theft of trade secrets, deceptive marketing, securities violations and civil RICO. Mr. Person recently represented a small oil and gas company that won an $18 million verdict for theft of trade secrets related to a Bakken shale prospect in Montana. This case was recognized as the 18th largest verdict in Texas in 2014 by Verdict Search. He also represented a class of small and large businesses against Verisign, Inc. for marketing of digital encryption certificates. The matter was certified as a national class action and was settled for approximately $40 million.
In employment law matters, Mr. Pearson represents current and former employees against their employers for claims of harassment, discrimination, retaliation and wrongful termination under Title VII, the TCHRA, ADA, EPA, ADEA and the FMLA. He also handles lawsuits involving claims of workers’ compensation retaliation, Whistleblower claims, Sabine Pilot, civil rights violations, breach of contract and wage and hour disputes. Mr. Pearson has experience representing executives in matters including breach of contract, covenants not to compete, and separation and severance agreements. Mr. Pearson has written several articles and given lectures on employment law matters.
During law school, Mr. Pearson was an associate editor of the Law Journal and interned for Hon. Eugene Cook at the Texas Supreme Court and the Hon. Emilio Garza of the United States Fifth Circuit Court of Appeals. He is licensed to practice law in Texas as well as the Northern, Southern, Western and Eastern Districts of Texas and the Fifth Circuit.
