Brendan McBride is the lawyer other lawyers go to make their cases better. Obtaining great results requires recognizing the best strategy early on in the case. In the past six years alone Mr. McBride has been called on by other lawyers to handle nearly 40 cases before state and federal appeals courts. And they have asked him to help design winning strategies for more than 200 other civil cases involving a wide array of subjects in federal and state courts around the country. That’s a lot.
Mr. McBride has extensive experience in litigation related to insurance coverage, commercial disputes, information and technology, commercial fraud, products liability, construction defects, special education, matters related to electronic discovery, real property litigation and civil appeals and extraordinary writs. Mr. McBride regularly practices in both state and federal courts, and handles complex litigation matters and appeals in Texas and across the country. His philosophy is that the key legal issues and strategy decisions that will define a case must be recognized and planned for at the outset. His practice encompasses all aspects of complex civil litigation strategy and civil appeals.
His background in commercial insurance coverage litigation has primarily been on behalf of policyholders and includes coverage disputes in both the first-party and third-party contexts. In construction defect matters, he has developed innovative and winning strategies in large commercial construction defect disputes involving both public construction projects, such as public schools and hospitals, as well as litigation arising out of private commercial construction projects, such as hotels, apartments, condominium buildings, and medical facilities.
As a former computer programmer and systems analyst, he has a background particularly well-suited to disputes involving information systems, software and technology, as well as matters likely to involve the complicated and emerging issues regarding electronic discovery. He also provides appellate and litigation support in complex commercial disputes between companies or between consumers and companies involving breach of contract, misrepresentation, fraud and deceptive trade practices.
He regularly presents papers and speaks at legal education seminars on a variety of matters related to advanced civil practice. He is also responsible for spearheading the creation of a new pro bono legal clinic designed to educate and empower families involved with the public special education system to act as advocates for their children in securing their legal right to a free and appropriate public education, which is now part of the San Antonio Bar Association’s Community Justice Program.
Mr. McBride is licensed to practice in the State of Texas, the State of Minnesota, all four federal districts in Texas (the Northern, Southern, Eastern & Western), as well the Federal Circuit Courts of Appeal for the Fifth and Tenth Circuits. He has provided litigation strategy and support in cases all across the country both in state courts and federal courts.
